The services provided by SimplerCloud for CloudSave and CloudSave Server backup plans are subject to the following terms and conditions.
We provide secure online backup services that allow customers (“you” or “Customer”) to store, access, and restore copies of their data through our platform. The services are provided on a self-managed basis, with the Customer responsible for configuration and data restoration.
Backup of the Content you designate occurs via your Internet connection at the time and frequency set by you. The Backup Service is not an archival service. It is solely your responsibility to maintain original versions of the Content that you backup through the Backup Service.
You are solely responsible for all Content and Account Information that you transmit, store, or restore through the Backup Service and to and from your account.
You agree that your use of the Backup Service will fully comply with all applicable laws, rules and regulations and that it will also comply with all regulations, policies and procedures of networks through which you access and use the Backup Service.
You must not use our backup services to store or transmit any data that is unlawful or in violation of applicable regulations, including but not limited to:
You are solely responsible for ensuring that all files uploaded to the backup service are free from viruses, trojans, ransomware, or other malicious code. We reserve the right to suspend or delete data that poses a threat to our systems or other users.
We do not guarantee the completeness, accuracy, or integrity of backup data. It is your responsibility to perform regular checks and test data restoration to ensure backups are functional and usable.
All customer backup data is encrypted in transit and at rest using industry-standard encryption protocols. We use secure transport (e.g. SFTP/SSH or SSL/TLS) for data uploads and AES-based encryption for data at rest on storage. Content is encrypted using a 256-bit AES algorithm by default, and remains encrypted at all times before restore. The encryption key is defined and must be kept securely by you. Only you can decrypt the Content using the encryption key.
You are responsible for safeguarding your credentials and keys where applicable. We don't have access to your encryption key, and we cannot access your data stored in the backup server. We cannot assist in restoring the data for you if you have lost the encryption key.
While we aim to provide reliable backup infrastructure, we do not guarantee that data can always be restored or will be intact, especially in the event of user error, malware, or hardware failure.
Our total aggregate liability to the Customer for any claims arising out of or in connection with the backup services, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by the Customer for such services during the applicable billing period (whether monthly, yearly, or biennial, as per the selected subscription plan).
Under no circumstances shall we be liable for any indirect, incidental, punitive, or consequential damages, including but not limited to loss of data, revenue, profits, or anticipated savings, even if advised of the possibility of such damages.
Upon termination or expiration of your subscription, we may delete all backup data after a grace period of 7 days, unless otherwise agreed in writing.
It is your responsibility to ensure that all necessary data is downloaded or restored before termination.
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.
